AMENDED PUBLIC NOTICE: Application for consideration of a Zoning By-law Amendment

The City of Cornwall’s Planning Advisory and Hearing Committee (PAC) will hold a public meeting on Monday, July 21, 2025, at 4:00 p.m., in the Council Chambers of City Hall. The purpose of the meeting is to consider an application for a Zoning By-law Amendment for the lands described as 55 Water Street West. In accordance with the Planning Act, the meeting will serve as an opportunity for the public to make representations in respect of the proposed amendment and to obtain further information about the following application:

1. ZONING BY-LAW AMENDMENT (Z-03-25)

A Zoning By-law Amendment will be considered at this meeting to rezone the subject lands. The proposed amendment is a condition of a recent consent application (file B-05-25) which was conditionally approved by the Committee of Adjustment on June 4, 2025. The conditionally approved consent is to create a new lot to facilitate separate ownership of the existing single detached dwelling at 27 Augustus Street from the balance of the subject property, which is proposed to contain the existing commercial use.

The subject lands are currently zoned Central Business District (CBD). The proposal seeks to rezone the portion of the subject lands (the conditionally approved severed lands as per file B-05-25) to a site-specific exception within the Central Business District (CBD) Zone to permit the existing single-detached dwelling at 27 Augustus Street and to establish appropriate performance standards in relation to the residential use. The applicant is seeking to introduce site-specific zoning provisions for the lot, as well as the built form, including yard setbacks, maximum lot occupancy and minimum landscaped open space.

The following site-specific standards are requested:
• Single-Detached Dwelling
o Minimum Lot Frontage: 12.8 metres
o Minimum Lot Area: 430.3 square metres
o Minimum Front Yard: 4.4 metres
o Minimum Interior Side Yard: 2.7 metres on the driveway side, 0.8 metres on the other side
o Minimum Rear Yard: 8 metres
o Minimum Landscaped Area: 30%
o Maximum Lot Occupancy: 35%
o Notwithstanding Section 3.19.2 (10c), the total area occupied by driveways, walkways, and surface parking shall not exceed 50% of the area of the entire front yard.

ADDITIONAL INFORMATION:
Additional information regarding the proposed subject amendment is available to the public for inspection at the office of the Planning Division, 100 Water Street East, 2nd Floor, Cornwall Civic Complex, during regular office hours.

If a person or public body would otherwise have an ability to appeal the decision of the City of Cornwall to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Planning Advisory and Hearing Committee before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Planning Advisory and Hearing Committee before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

The subject lands are subject to an application under the Act for a consent (file number B-05-25) which was conditionally approved by the Committee of Adjustment of the City of Cornwall on June 4, 2025. As far as is known, the subject land is not the subject of an application under the Act for a minor variance, a Minister’s zoning order, or for approval of a plan of subdivision.
