Notice of Public Hearing Committee of Adjustment City of Cornwall Application for Minor Variance – File # A-15-26
Take notice that an application under the above file number will be heard by the Committee of Adjustment on Wednesday, May 20th, 2026 at 05:00 p.m. at Council Chambers at City Hall, 360 Pitt Street, Cornwall, Ontario K6J 4P6.
The purpose of the meeting is to consider an application for a minor variance from the provisions of the City of Cornwall Zoning By-law 2022-001 as amended, for the lands legally described as Part Lot 9 North Side of Seventh Street, municipally known as 711 Amelia Street.
The requested variances are to accommodate the conversion of the existing building (a triplex dwelling) into the proposed quadruplex dwelling. A new driveway is also being proposed to provide parking 3 spaces within the private property.
The proponent is seeking relief from the Zoning By-law for the following:
- Section 3.3.1 – To permit an amenity area of 35.75 m2 for four dwelling units, whereas the Zoning By-law requires a minimum of 40 m2 (10 m2 for each dwelling unit).
- Section 3.3.3 – To permit a communal amenity area of 35.75 m2, whereas the Zoning By-law requires communal amenity areas to be a minimum of 40 m2.
- Section 3.3.4 – To permit the width of the barrier-free path of travel to be 1 m when connecting to communal amenity areas exterior to the building, whereas the Zoning By-law requires a minimum width of 1.5 m for the barrier-free path of travel.
- Section 3.18.3.1 – To permit the use of an undersized or small lot, where the lot does not meet the minimum lot area or frontage requirements, to be used and a building or structure to be erected upon for a permitted use in the zone while other applicable zoning provisions are not satisfied, whereas the Zoning By-law permits the use and development of such lots only when the other applicable zoning provisions are satisfied.
- Section 3.21.2.3 – To permit the location of a required parking space in a sight triangle, whereas the Zoning By-law does not permit it.
- Section 3.21.2.4 – To permit the location of the driveway to be between the front wall of the residential use building and the street, whereas the Zoning By-law does not permit it.
- Section 3.21.2.7 – To permit the parking in the required front yard in the case of multiple unit dwellings, whereas the Zoning By-law does not permit it.
- Section 3.21.2.10.b) – To permit a 2.166 m-wide landscaping strip along Seventh Street East for quadruplexes where parking spaces are located in the front yard, whereas the Zoning By-law requires a minimum 3 m-wide landscaping strip along any lot line abutting a street in the case of a quadruplex dwelling with parking located in the front yard.
- Section 3.21.2.10.d) – To permit a ratio of 66% for the front yard hard surface to soft landscaping ratio for quadruplexes, whereas the Zoning By-law permits a maximum of 50%.
- Section 3.21.2.10.f) – To permit a driveway with a width of 7.8 m at street line for 1 to 4 dwelling units, whereas the Zoning By-law permits a maximum width of 6 m at street line.
- Section 3.21.7.1 – To permit 3 required parking spaces for a quadruplex dwelling, whereas the Zoning By-law requires a minimum of 4 required parking spaces (1 space per dwelling unit) for a quadruplex dwelling.
- Section 6.2.1.a) – To permit a lot frontage of 13.41 m for a quadruplex dwelling, whereas the Zoning By-law requires a minimum lot frontage of 18 m.
- Section 6.2.1.d) iii) – To permit an interior side yard setback (driveway side) of 1.16 m for a quadruplex dwelling, whereas the Zoning By-law requires a minimum interior side yard setback of 3 m.
- Section 6.2.1.f) – To permit a rear yard setback of 4.214 m for a quadruplex dwelling, whereas the Zoning By-law requires a minimum rear yard setback of 8 m.
- Section 6.2.1.g) – To permit a lot occupancy of 43% for a quadruplex dwelling, whereas the Zoning By-law permits a maximum lot occupancy of 40%.
