Notice of Decision: Marguerite d'Youville Draft Plan of Subdivision

This notice is to advise you in accordance with Sections 51, of The Planning Act that the Council of the Corporation of the City of Cornwall has made the decision:

Planning Item #1 - Approved the Marguerite D’Youville Draft Plan of Subdivision (Phases 1-3) Residential lands with lot frontage along Marguerite D’Youville and Easton Avenue, Cornwall Ontario.

For Phases 1-3 of the Marguerite D’Youville Draft Plan of Subdivision

Take Notice that on the 27th day of September 2021, the Council of the Corporation of the City of Cornwall approved via Resolution 2021-15, an application for a Draft Plan of Subdivision under Section 51 of the Planning Act, R.S.O. 1990., consisting of 24 single detached lots  (24 residential dwelling units), to be developed as Phase 1, Block 1 for Parkland Dedication and Blocks 2 and 3 as future residential developments on lands legally described as Part of Lot 1, Concession 1 as shown on Reference Plan 52R-5198. 

A copy of the proposed Draft Plan of Subdivision can be reviewed by contacting: Lindsay Parisien, Development Planner, at lparisien@cornwall.ca.  Please refer to Folder #312 and File No. 04T-2021-03 in your request.

Take Notice that any public body that did not make oral submissions at the Applicable public meeting(s) or make written submissions to the Planning Advisory Committee (PAC) in respect of the proposed amendments, that person or public body is not entitled to appeal the decision of the City of Cornwall’s Planning Advisory Committee (PAC) to the Ontario Land Tribunal (as an interested party to this matter). Further, the person or public body may not be added as a party to the hearing of an appeal to the Ontario Land Tribunal, unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Only individuals, corporations or public bodies may appeal the decision in respect of the proposed subdivision and associated Zoning amendments to the Ontario Land Tribunal.  A Notice of Appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of an appeal of the decision of the approval authority, unless the person or public body, before the decision of the approval authority, made an oral submission at a public meeting or written submission to the Council or, in the Ontario Land Tribunal ‘s opinion, there are reasonable grounds to add the person or public body as a party.

And Take Notice that any person or agency may appeal the decision of the Council to the Ontario Land Tribunal in respect of Resolution 2021-15by filing, with the Clerk of The Corporation of the City of Cornwall no later than Friday October 22nd, 2021, a Notice of Appeal setting out the objections to the Resolution and Zoning amendments and the reasons in support of the objections.
