Notice of Application for Approval of a Plan of Subdivision and Zoning By-law Amendments Under Section 51, Sections 34 and 36 of the Planning Act

Application for consideration of a Draft Plan of Subdivision and amendment(s) to the City of Cornwall Comprehensive Zoning By-law as amended, as described herein this Notice.

Subject: The City of Cornwall Planning Advisory and Hearing Committee (PAC) will hold a Public meeting on Monday, December 21st, 2020 at 7 p.m., in Salon B of the Cornwall Civic Complex (Lower Concourse). The purpose of the meeting is to consider the following application and Zoning By-law amendments.

Application for a Proposed Draft Plan of Subdivision and Zoning By-law Amendments (THIS ITEM WAS DEFERRED IN NOVEMBER 2020):

  1. The application is to consider a request for a Draft Plan of Subdivision, Belfort Subdivision Phase 2 located east of Walton Street and Belfort Crescent legally described as Part of the East ½ of Lot 5 and Part of Lot 4, Concession 1. The proposed Plan of Subdivision consists of approximately 2.382 hectares (5.9 acres) and is comprised of twenty-one (21) single detached and ten (10) semi-detached dwellings, totalling 41 residential units. The effect of the Draft Plan is to enable the registration of a subdivision plan for these lands which are suitable for residential development.

At this meeting, a corresponding Zoning By-law amendment to lift the Hold (H) Category and rezone the lands from Manufacturing 20 with a Hold (MFR 20 H) to Residential 20 with site specific exceptions (RES 20 EXC) will also be considered.

AS A RESULT OF THE COVID-19 VIRUS, THE CITY OF CORNWALL WOULD ASK THAT SHOULD YOU HAVE ANY CONCERNS WITH THESE APPLICATIONS AND WISH TO ATTEND THE PUBLIC HEARING, PLEASE REGISTER WITH THE PLANNING DIVISION BY EMAIL AT edaniels@cornwall.ca OR BY PHONE (613) 930-2787 EX: 2328 BY THE LATEST FRIDAY DECEMBER 18TH, 2020.

PHYSICAL DISTANCING MEASURES WILL BE IN PLACE THROUGHOUT THE MEETING.  ATTENDEES SHOULD SANITIZE THEIR HANDS UPON ARRIVAL AND WEAR A MASK IF POSSIBLE.  RESIDENTS WHO ARE FEELING SICK SHOULD STAY HOME AND SUBMIT THEIR COMMENTS IN WRITING.

Additional information regarding the proposed Draft Plan of Subdivision and Zoning By-law amendments are available to the public for inspection at the office of the Planning Division, 100 Water Street East, 2nd Floor, Cornwall Civic Complex, during regular office hours.

If a person or public body does not make an oral submission at the public meeting or make a written submission to the Planning Advisory and Hearing Committee (PAC) in respect of the proposed subject Draft Plan of Subdivision and Zoning amendments before the approval authority gives or refuses to give approval to the proposed applications, then the person or public body is not entitled to appeal the decision of the City of Cornwall’s PAC to the Local Planning Appeal Tribunal (LPAT), and may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal (LPAT) unless, in the opinion of the LPAT, there are reasonable grounds to do so.
