Notice of Passing - Bellwood Ridge Development

This notice is to advise you in accordance with Section 51, of The Planning Act that the Council of the Corporation of the City of Cornwall has made the decision to:

Approve with Conditions - Draft Plan of Subdivision on Residential lands located on the south side of Tollgate Road and east of Pitt Street, Cornwall Ontario.

File No. 04T-2019-03 For the Bellwood Ridge Development Draft Plan of Subdivision

Take Notice that on the 12th day of August 2019, the Council of the Corporation of the City of Cornwall approved via Resolution 2019- 10, an application for Draft Plan of Subdivision under Section 51 of the Planning Act, R.S.O. 1990 for the development of a 184 residential lots (29 singles, 155 semi-detached lots) that are to be developed over three phases (Phases 4 and 5, followed by the remaining draft plan approved lands). A copy of the proposed Draft Plan of Subdivision is available for inspection at the City of Cornwall Planning Division from 8:30-4:30 pm on regular business days. Please refer to File No. 04T-2019-03.

Take Notice that any person or agency may appeal the decision of the Council to the Local Planning Appeal Tribunal in respect of the Resolution by filing, with the Clerk of The Corporation of the City of Cornwall no later than Tuesday September 10th, 2019 a Notice of Appeal setting out the objections to the Resolution and the reasons in support of the objection.

And Take Notice that any public body that does not make oral submissions at the Applicable public meeting(s) or make written submissions to the Planning Advisory Committee (PAC) in respect of the proposed conversion that person or public body is not entitled to appeal the decision of the City of Cornwall’s Planning Advisory Committee (PAC) to the Local Planning Appeal Tribunal (as an interested party to this matter). Further, the person or public body may not be added as a party to the hearing of an appeal to the Local Planning Appeal Tribunal, unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Only individuals, corporations or public bodies may appeal the decision in respect of the proposed draft plan of subdivision to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of an appeal of the decision of the approval authority, unless the person or public body, before the decision of the approval authority, made oral submission at a public meeting or written submission to the council or, in the Local Planning Appeal Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
