Notice of Meeting and Approval of Zoning By-law Amendments Under Section 34 of the Planning Act

Notice of proposed Amendment to the City of Cornwall’s Heart of the City and Brownfield Community Improvement Plans
under Section 28 of the Planning Act

Public Meeting Date: Tuesday May 21, 2013 at 7 pm
Council Chambers, City Hall, 360 Pitt Street Cornwall, ON K6J 3P9

1. Proposed Housekeeping Number 18 Zoning By-law Amendment(Rezoning) Textual and Mapping changes:

City initiated application is being made by City staff for a Zoning By-law Amendment (Housekeeping No. 18) to make technical modifications to various sections of the City of Cornwall’s Comprehensive Zoning By-law No. 751-1969, as amended.

The modifications are intended to assist both staff and the public in clarifying certain regulations and are commonly referred to as “Housekeeping Changes”.

The proposed changes include, but are not limited to, the following items:

  • Clarification to Section 01-2-8 and 01-2-8a) GENERAL concerning the reconstruction of buildings/ porches and entrances to include a time frame of one year from the date a demolition permit is issued.
  • Stipulate that the Home Occupation provisions Section 01-2-18 shall only apply to single family dwellings and two unit dwellings.
  • In the definition Section 01-1-1 review the current definition for Service Station and Automotive Centre.
  • In the Parking Section 01-3-1 clarify the parking standards for in the Commercial Section by introducing Restaurants, Bars & Taverns.
  • Modify Section 02-2-3 Residential 20 to introduce a Minimum Frontage section for Row House Linear units to indicate 20.5 metres, plus refer to Section K.

Mapping Changes:

  • Recognize existing residential dwelling located at 31-33 William Street and 1 William Street zoned as Manufacturing 20 (MAN 20) and change zoning to Residential 20 (RES 20), to be permitted uses at the time of the passing of this By-law (see map at top left).
  • Corrections of mapping error to recognize Residential 20 (RES 20) zoning provisions for the two residential dwellings located at 1 Gail Elizabeth and 2044 Blessed Sacrament Drive (see map top centre)

2. Application by BTB Real Estate Investment Trust

An application by BTB Real Estate Investment Trust (owner) for a Zoning Bylaw Amendment (Rezoning) at 805 Boundary Road, legally described as Part of Lot D, Concession 1 (Parts 1 – 7, Plan RP52R6902), City of Cornwall.

The nature of the amendment is to rezone the subject site from Manufacturing 40 (MFR40) to a new hybrid Manufacturing 40 (MFR40) zone, incorporating numerous permitted uses from the other existing Manufacturing type zones found in the City’s Comprehensive Zoning Bylaw.

The intent is to allow a sufficient range of use to facilitate attraction of an expanded tenant mix within a comprehensive phase redevelopment
of the approximate 18 acre parcel. The proposal will ultimately see both existing renovated and new constructed space, on multiple building pads, forming a contemporary Business Park project at the southwest corner of Boundary Road and Marleau Avenue.

3. Proposed Amendment to the City of Cornwall’s Heart of the City Community Improvement Plan and Brownfield Community Improvement Plan

1. A textual change to Program 1: Heart of the City Rehabilitation and Redevelopment Grant (Tax Increment Grant) and City of Cornwall Brownfield Rehabilitation Grant (Tax Increment Grant) respectively, to establish a starting tax base under certain circumstances and to clarify the maximum program duration for multi-phase projects.

2. A proposed amendment to the City of Cornwall’s Heart of the City Community Improvement Plan (October 2005) to introduce a new as Program 8: Le Village Residential Facade Improvement Program. This program has been drafted by administration in accordance with the Municipal Act & Planning Act (Section 28).

This is a textual change only & the OP Schedule 6: Community Improvement Policy Area is not proposed to be altered.

If a person or public body does not make oral submissions at the public meeting or make written submissions to the PAC in respect of the proposed items before the approval authority gives or refuses to give approval to the items, the person or public body is not entitled to appeal the decision of the City of Cornwall’s PAC to the Ontario Municipal Board. If a person or public body does not make oral submissions at the public meeting or make written submissions to the PAC in respect of the proposed items, before the approval authority gives or refuses to give approval to the proposed items, the person or public body may not be added as a party to the hearing of an appeal to the Ontario Municipal Board, unless, in the opinion of the Board, there are reasonable grounds to do so.

At this meeting, it is the intention of the Committee to review applications/initiatives and hear objections, comments, or receive briefs before making a recommendation to City Council.
