NOTICE OF PUBLIC MEETING
Review of Zoning By-law amendment(s) under Section 34 of the Planning Act

Application for the consideration of Amendments to the City of Cornwall Comprehensive Zoning By-law, as described herein this Notice.

Proposed Housekeeping Number 19 Zoning By-law Amendment (Rezoning for Textual and Mapping Changes):

City initiated application is being made by City staff for a Zoning By-law Amendment (Housekeeping No. 19) to make technical modifications to various sections of the City of Cornwall’s Comprehensive Zoning By-law No. 751-1969, as amended. The modifications are intended to assist both staff and the public in clarifying certain regulations, and are commonly referred to as “Housekeeping Changes”. The proposed changes include, but are not limited to, the following items:

  • Clarification to Institutional 10 Section 06-1-6 Two or More Buildings on a Single parcel, amend the definition to remove “Multiple Family Dwellings”, and replace with the word “Buildings”.
  • Introduce in the General Section 01-2-23 Bed and Breakfast Provisions, this will state that the establishment of Bed and Breakfast may take place in existing single family dwellings.
  • In the Permitted Uses Commercial 12 Section 03-3-3 add a statement to recognize existing residential dwellings to be legal land uses.
  • Provide for recognition of ‘Fish Farm’ in the Definition Section 01-1-1 in the current Agricultural uses.
  • Add to the existing definition for Dormitory in Definition Section 01-1-1 a ‘Student Residence’ & for this use to be introduced into the Institutional zones.
  • Add to the Central Business District Section 03-10-5 Building and Lot Requirements, provision ‘Mixed Use’ and Non-Residential Building to the title and section.
  • In General Section 01-2-5 Accessory Buildings. Add a statement that ‘accessory uses’ directly linked to the main uses are permitted in all zones. Also amend the numeric values for the height of accessory buildings from grade to eaves to be 3 metres and from grade to peek to be 5 metres.
  • In General Section 01-2-18 Home Occupation Standards introduce a statement that permits Home Occupation into single & semi detached dwelling units only.
  • In General Section 01-2-8 Reconstruction of Buildings and Section -1-2-8a Exception: Reconstruction of Porches and Entrance Decks in the Front Yard add a time frame of one year from the date of the issuance of demolition permit. Also in Section 01-2-8 include the word “such as” earthquake fire, floods.
  • In Residential 15 Section 02-1A-3 provision (d) Minimum Side Yard, amend the minimum side yard on carport side to be 0.5 metres, from 0.45 metres on a single family dwelling.
  • Mapping Correction Changes: Recognize the commercial garage at 1000 Tollgate Road West currently zoned as Residential 20 (Res20) to be zoned as (CH) Highway Commercial, and recognize as a permitted land use at time of passing of this By-law (see map at right).

Additional information regarding the proposed Zoning By-law Amendment is available to the public for inspection at the office of the Planning Division, 100 Water Street East, 2nd Floor, Cornwall Civic Complex, Cornwall, during regular office hours.

If a person or public body does not make oral submissions at the public meeting or make written submissions to the PAC in respect of the proposed Zoning By-law Amendment before the approval authority gives or refuses to give approval to the Zoning By-law Amendment, the person or public body is not entitled to appeal the decision of the City of Cornwall’s PAC to the Ontario Municipal Board.

If a person or public body does not make oral submissions at the public meeting or make written submissions to the PAC in respect of the proposed Zoning By-law Amendment before the approval authority gives or refuses to give approval to the proposed Zoning By-law Amendment, the person or public body may not be added as a party to the hearing of an appeal to the Ontario Municipal Board, unless, in the opinion of the Board, there are reasonable grounds to do so.

At this meeting, it is the intention of the Committee to review applications/initiatives and hear objections, comments, or receive briefs before making a recommendation to City Council.
