Notice of Passing of Zoning By-Law
The Corporation of the City of Cornwall

Take notice that the Council of The Corporation of the City of Cornwall passed By-law 2017-127 on Monday, September 11, 2017, under Chap. P13, s.34 (18)(19) of the Planning Act, R.S.O. 1990 as amended; and

Take notice that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing, with the Clerk of The Corporation of the City of Cornwall no later than Monday, October 16, 2017, a Notice of Appeal setting out the objections to the By-law and the reasons in support of the objection.

Only individuals, corporations and public bodies may appeal a Zoning By-Law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.

An explanation of the purpose and effect of the By-law describing those lands to which the By-law applies or, alternatively, an explanation as to why key map is not provided are attached. The complete By-law is available for inspection in the Clerk’s Office during regular office hours.

Explanation of Purpose and Effect of By-Law 2017-127

Purpose
The Purpose and Effect of this By-law is to introduce a Place of Assembly and Recreation use at 525 Boundary Road requires a Site Specific Zoning exception to the Manufacturing 40 (MFR 40) zoning associated with the site. The exception is required because the regulations of the current zoning do not speak to the nature of proposed activities (Cornwall Gymnastics Club). The Planning Division has reviewed the application along with relevant supporting documentation, and has come to the conclusion that:

i. The intended Place of Assembly and Recreation use is generally meeting the intent of the Industrial Designation policies in relation to service commercial uses.

ii. The site location, ease of access and abundance of designated parking support the rezoning. This is an opportunity to re-purpose a vacant portion of a low intensity industrial development with a service commercial use component which should not interfere with existing and future operations within the building. The building is in good standing (structurally) and there are no known past industrial uses that were contained on site or located in the immediate vicinity that would be a cause of concern for the health of the general public that would frequent the site

iii. The Place of Assembly and Recreation use establishing in a manufacturing zone is consistent with past decisions.
