Commercial - Industrial Vacancy Rebates

This rebate program provides tax relief to property owners where a building or a portion of a building is vacant within the prescribed commercial and industrial property classes. Rebates will be issued by the municipality to owners who submit a Commercial/Industrial Vacancy Rebate Application according to the instructions below.

Property owners who are eligible for a rebate can submit an application to the municipality each year that a building, or portion of a building, is vacant for at least 90 consecutive days in a given taxation year. Two options are available for submitting rebate applications:

  1. One application (interim) for vacancies that occurred during the first six months of the year and a second application (final) for vacancies that occurred during the last six months of the year; OR
  2. One application to cover all vacancies that occurred on that property during that taxation year.

The interim application may be submitted by July 31 of any year with respect to the period January 1 to June 30 of that year.

The deadline for submitting applications is February 28 of the year following the taxation year to which the application relates. The deadline for the 2016 taxation year is February 28, 2017.

Exclusions

  • Seasonal Property: Businesses that operate on a seasonal basis are not eligible for a rebate for the seasons they are closed.
  • Leased Property: Buildings or portions that are vacant but are leased to a tenant are not eligible for a rebate.
  • Vacant Land Sub-Class: Buildings that are included in a vacant land sub-class (e.g. new buildings that have never been occupied) are not eligible for a rebate.

The rebate program is governed by Section 364 of the Municipal Act and Ontario Regulation 325/01. Copies of the legislation and regulations may be viewed on the Government of Ontario "e-laws" web site, http://www.e-laws.gov.on.ca.

Application Form

Property owners or their authorized representative must return the application completed and signed along with any additional documentation (copies only as originals will not be returned) such as expired leases or any other material that would substantiate the application.  Applications will be monitored and are subject to verification through site inspections.  Please keep a copy of your application as the City will retain the originals.

Processing the Application

Upon receipt in the Finance Department, the application will be checked for completeness and date stamped accordingly.  An incomplete application cannot be processed and will either be denied or returned with a request for more information.  A site inspection may be requested to verify size of vacant area.   The applications are forwarded to the Municipal Property Assessment Corporation (MPAC), where a value will be assigned to the vacant portion of the property.  MPAC will then returned the assigned applications to our office.   Our office will verify the information provided on the application and determine the rebate using a pre-determined formulae.   Upon approval by the City Collector, the rebate will then be applied to the applicable tax account.  Should the property taxes be paid  in full, a rebate cheque will be mailed out.
